Canada's Anti-spam legislation (CASL) comes into effect July 1, 2014

Here are the facts about the world’s most stringent anti-spam legislation:

What's happened?

• The Electronic Commerce Protection Regulations of Canada’s Antispam Legislation (CASL) were given PCO approval last week and will be published in Gazette II on December 18.

• Anti-spam provisions of CASL comes into force on July 1, 2014.

• Malware provisions of CASL comes into force Jan. 15, 2015.

What does this mean?

• You will need consent to send most forms of commercial electronic messages (CEMs). This includes email, SMS text and some forms of instant messaging.

• You cannot send a CEM to acquire consent.

• Consent must be “opt-in” (a pre-checked box on a website not acceptable).

• Consent must be verifiable (you need to document the where, when and how consent was acquired).

• All CEMs must have a one-step electronic mechanism to unsubscribe from future messages

• All messages must include prescribed information about the sender and sender’s contact information.

• You will also need consent to place a computer program on another person’s computing device.

• There are several exemptions that provide relief from the prohibition on sending messages but still require that CEMs include an "unsubscribe" mechanism and prescribed information.  These are an existing family relationship and existing business or non-business relationship. 

• The existing business relationship exemption has been greatly improved since the last version of the regulation was published in Gazette 1.

• Another improvement is the limiting of CASL to messages sent outside of Canada. Messages sent outside of Canada must comply with the law of the jurisdiction where the message is sent. If there is no spam law in that jurisdiction, then CASL applies.

What are we doing?

• The Canadian Chamber is providing compliance recommendations.

• We will be posting an FAQ section on the Chamber’s website.

• Hosting a webinar at the end of January 2014.

• The Canadian Chamber is following-up with Industry Canada and the CRTC to clarify compliance requirements for existing consents.

What can you do?

• Read and be familiar with the Act, Regulations, Regulatory Impact Assessment Statement, CRTC regulations and compliance guidelines.  These can find all of these on Industry Canada’s website at www.fightspam.ca.

• Participate in the Chamber’s webinar on January 29th (details to come).

 


Canada Post's 5 Point Action Plan

Canada Post’s five-point action plan will rejig postal service in Canada. This will have significant implications for some users, including many businesses. While the changes announced will be felt most among urban residential customers, businesses will experience some of the same price increases as those announced for residential customers. You are encouraged to be in touch with us if you have specific concerns. Canada Post has assured us it will respond to questions and concerns, and we will make these answers available to our membership as it does. With regards to the changes announced, Canada Post has made available both a report following up on its consultations earlier in 2013 and a short video.
